In “So Ordered,” a collection of 19 speeches, seven of them delivered to Catholic groups, Alito calls the 2015 Obergefell decision “perhaps the decisive point in our nation’s turn against religious liberty.” He compares opponents of same-sex marriage to Catholics who were persecuted in post-Reformation England, declaring that “what I predicted in my dissent is coming to pass.” Despite claiming in 2025 that he was “not suggesting that the decision should be overruled,” Alito is now publicly casting the ruling as the moment America turned on people of faith, laying out exactly the kind of argument used to justify reversing precedent.
