The Safeguard American Voter Eligibility (SAVE) Act, recently passed by the U.S. House of Representatives, introduces stringent voter registration requirements that could disproportionately affect women voters, particularly those who have changed their names due to marriage. The Act mandates that individuals present in-person documentary proof of U.S. citizenship—such as a passport or birth certificate—when registering or updating their voter registration. This requirement poses challenges for married women whose legal names differ from those on their birth certificates because of name changes. Approximately 69 million American women have taken their husbands' last names after marriage, resulting in a mismatch between their current legal names and their birth certificates. Under the SAVE Act, these women would likely need to provide additional documentation, such as a marriage certificate or legal name change order, to register to vote. However, the Act does not specify which documents would be acceptable, creating uncertainty and potential barriers for these voters. Voting rights advocates warn that the SAVE Act could stop millions of women, especially married women, by imposing additional bureaucratic hurdles. They argue that requiring in-person presentation of citizenship documents could deter eligible voters from registering or updating their information, thereby suppressing voter participation among affected women. While the Act aims to prevent noncitizen voting—a concern already addressed by existing laws—critics argue that it imposes unnecessary barriers that could disproportionately affect women.
