A frequent question from TRAs about the Supreme Court clarification and ECHR guidance that people must use the facilities appropriate to their sex,is how is that going to be enforced? They think this is a real gotcha question. Will there be genital inspections? This is all rather silly of course. British people will use their common sense. Let’s go through the options. We’ll take the example of the female changing rooms in a local swimming pool run by the council. 1️⃣ People obey the law This is the most obvious scenario. There has been no lack of publicity around the ruling and guidance, and those who have previously used the wrong changing rooms will, in the main, accept the rule of law. 2️⃣ Challenge by other users Again, since the ruling and guidance are so well known, other changing room users may feel emboldened to make a personal challenge. 3️⃣ Challenge by Attendant Attendants may now act on the guidance, off their own bat or when asked by other users. To the implicit question how will people recognise TiMs/ TiWs without a genital inspection, the answer is very few actually pass, and if they do and decide to break the law, that’s a few borderline cases and they don’t matter.
